Terms of Service for Hosted PBX, SIP Trunking & 911 Services
Overview
In addition to the terms and conditions in master service agreement (MSA), the following terms and conditions apply to your Hosted PBX, SIP Trunking, and 911 services. In the event of a discrepancy between these terms and the mater service agreement, these terms will take precedence,
Hosted PBX and SIP telephone service uses the Internet, not a telephone line to connect a telephone call. Although this service acts the same as a traditional telephone and connects you to the Public Switched Telephone Network (PSTN), there are important factors for you to consider regarding the usage of your telephone service for emergency calling. The IMPORTANT DIFFERENCES between Hosted PBX and SIP Trunking and a Traditional Phone Line are set out in the following terms and conditions.
1. Limitations: 9-1-1 dialling on your Hosted PBX and SIP Trunking has the following limitations when compared to 9-1-1 dialling on a traditional phone line. These limitations are as follows:
i. When you dial 9-1-1 on your digital phone services (Hosted PBX and SIP Trunking) the call will be routed to a specialized call centre that handles emergency calls. This call centre is different and separate from the Public Safety Answering Point (PSAP) that would pick up a 9-1-1 call made on a traditional telephone line. When making a 9-1-1 call on your digital phone services you will be required to provide your name, telephone number and address to the call centre operator.
ii. You agree to notify Northwest TelData immediately should you INTEND to change Your use of your Service, including without limitation, should you move the location or municipal address from which you use your service, by logging onto http://www.nwtcom.com or by telephone at 604-998-5000 to ensure You maintain 9-1-1 service.
iii. You acknowledge and understand that by:
a) Changing your use of your Hosted PBX and SIP Trunking without first notifying Northwest TelData and/or
b) Choosing to operate your Hosted PBX and SIP Trunking outside of the municipal address registered with Northwest TelData, either temporarily or permanently
Your 9-1-1 Service will not operate properly and your ability to access 9-1-1 service will be adversely affected.
iv. YOU ACKNOWLEDGE AND AGREE THAT NORTHWEST TELDATA AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS AND UNDERLYING CARRIERS, WILL NOT BE LIABLE FOR ANY INJURY, DEATH OR DAMAGE TO PERSONS OR PROPERTY, ARISING DIRECTLY OR INDIRECTLY OUT OF, OR RELATING TO THE 9-1-1 SERVICE AND YOU AGREE TO INDEMNIFY AND HOLD HARMLESS NORTHWEST TELDATA (AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS AND UNDERLYING CARRIERS) FOR ANY LIABILITIES, CLAIMS, DAMAGES, LOSSES AND EXPENSES, (INCLUDING REASONABLE LEGAL FEES AND EXPENSES) WHICH YOU MAY SUFFER OR INCUR, ARISING DIRECTLY OR INDIRECTLY OUT OF OR RELATING TO 9-1-1 SERVICE WITH HOSTED PBX AND/OR SIP TRUNKING SERVICES.
v. Service outages: You acknowledge and understand that during Internet connection service outages for any reason whatsoever, your digital phone service INCLUDING 9-1-1 SERVICE, will not work.
vi. Loss of service due to power failure: You acknowledge and understand in the event of a power failure, your service; INCLUDING 9-1-1 SERVICE will not work. If there is an interruption in the power supply, 9-1-1 SERVICE, will not function until power is restored. A power failure or disruption may require you to re-set or reconfigure equipment prior to using the service.
vii. Service Outage Due to suspension of your account: You acknowledge and understand that service outages due to suspension of your account as a result of billing issues will prevent service, INCLUDING 9-1-1 SERVICE, from functioning.
2. Operator Services Currently Not Available: Northwest TelData does not currently offer operator service for your Hosted PBX and SIP Trunking services.
3. Automatic Outbound Dialers: Northwest TelData strictly forbids the use of any automatic outbound diallers of any kind in Hosted PBX and SIP Trunking Service. Use of an automatic outbound dialler may result in the immediate Suspension of Your Service without notice. Northwest TelData reserves the right to charge full cancellation fees for the remaining term of your service agreement.
4. Caller Line ID: Caller Line ID on SIP Trunking Service must be a name and number that you are authorized to use and in accordance with CRTC regulations. By changing the Caller Line ID you understand and acknowledge these regulations.
5. Collect Calls: Collect Calls are blocked on Hosted PBX and SIP Trunking services from Northwest TelData.
6. Long Distance: Long Distance cannot be PIC’d away from Northwest TelData on Hosted PBX and SIP Trunking services.
7. Premium 900/976 Dialing: Premium 900/976 dialing is blocked on Hosted PBX and SIP Trunking.
